Terms and Conditions

The following notices and terms govern the registration for all Japan stays. We also inform you of your right of withdrawal, which you are entitled to if you – as is usually the case – participate in a course as a consumer and register for it via remote communication (e.g., online, email, letter).

  1. Scope

These general terms and conditions apply to all services provided by Eurasia-Linkup Nipponcademy GmbH (hereinafter “Nipponcademy”) to clients. Any deviating conditions require written confirmation from Nipponcademy to be effective.

  1. Conclusion of Contract

Registration is done through the registration forms on www.nipponcademy.com. A binding contract is concluded only with a written registration confirmation. Both parties may withdraw from the registration and associated obligations up to 45 days before the start of the booked Japan stay, or at the latest, until the payment of the fees. By registering, both parties accept the participation conditions. German law applies.

Registration for a Japan stay is done through the registration forms on our website or through email registration forms that can be submitted via email, post, or in person. A binding contract is concluded with the sending of our registration confirmation by email, regardless of payment receipt. Both parties may withdraw from the registration and associated obligations up to 45 days before the start of the course, or at the latest, until the payment of the fees. By registering, both parties accept the participation conditions.

  1. Contract Partners, Customer Service

3.1. Registration for a Japan stay: The contract partner for all services related to registration and preparation for the Japan stay, as well as support in Japan, is Nipponcademy.

3.2. Japanese Course: The contract partner for the Japanese courses offered in Japan is specified in the program description. The address of the contract partner (the language school) can be found in a PDF file attached to these terms and conditions.

3.3. Accommodation: The contract partner for accommodation varies according to the customer’s needs, as Nipponcademy cooperates with various companies. The exact details are stated on the invoice and discussed individually with the customer.

  1. Due Date

After reserving all ordered services, a detailed cost breakdown will be visible in the “Invoice” section of the customer’s account. The fee must be paid no later than 45 days before the course start date, which is visible in the customer account. However, payment must be made within 10 days of the email payment request. Otherwise, Nipponcademy reserves the right to refuse all services and cancel reservations with contract partners.

  1. Payment

5.1. All fees, including school and accommodation fees, must be transferred to Nipponcademy’s German bank account. A cost breakdown is visible in the invoice section of the customer’s account. Additional costs may apply for payments via PayPal or credit card through a third-party payment provider due to higher transaction fees.

5.2. Composition of Costs and Contract Relationships for Language Courses and Accommodations

The total cost for our Japan stays consists of various components, including school fees for language courses and accommodation costs. It is important to understand that Nipponcademy acts as an organizer and intermediary in these cases:

Language Courses: The direct contract partner for the language courses is the respective language school in Japan, not Nipponcademy. The school fees included in the total price are forwarded directly to the language school. These fees are detailed in a PDF file attached to these terms and conditions.

Accommodation: Similar to the language courses, the contract partner for accommodation is a separate company and not Nipponcademy. The exact costs and conditions for accommodation vary depending on the provider and are discussed individually with the customers and specified on the invoice.

Organization, Mediation, and Support by Nipponcademy: Our role includes organizing and mediating the trip, including booking language courses and accommodations, as well as providing comprehensive advice and support throughout the stay. We are always available to our customers for advice and offer support for any questions or problems that may arise during the stay in Japan. The service and advisory fees for these comprehensive mediation and support services are part of the total price and are charged by Nipponcademy for the coordination, advice, and support of these services.

We place great emphasis on providing our customers with a transparent cost structure and ensuring that all aspects of the trip are clearly and understandably communicated.

5.3. Handling and Cost Structure for Accommodations

In arranging accommodations for our customers, we follow a clear and customer-friendly process:

Billing in Yen by Contract Partners and Payment in Euros to Nipponcademy: The contract partners issue invoices for accommodations in Japanese yen to ensure transparency of the original costs. To simplify the payment process for our customers, we accept payment of rental fees in euros. The converted amount in euros is indicated in the cost breakdown and may be slightly higher to account for exchange rate fluctuations and ensure a smooth process.

Handling of Registration Fees: Some accommodations have registration fees that can vary. To simplify the cost structure for our customers, we have established a flat registration fee of 790€. This flat fee covers the actual registration fees as well as a service fee for our mediation services. The portion of the flat fee that exceeds the actual registration fees of the accommodation is retained by Nipponcademy as a service fee for arranging and coordinating the accommodation.

  1. Cancellation / Withdrawal / Termination

Withdrawal from registration is possible up to 45 days before the start of the booked service, or at the latest until full payment of the fees, without additional costs. After confirmation of payment by Nipponcademy, cancellation fees will apply in case of withdrawal. These include 100% of Nipponcademy’s service fee as well as the cancellation fees of the language school listed in the PDF file attached to these terms and conditions. If there is no cancellation and no payment from the customer, a penalty fee of 290€ will be charged starting from the 30th day before the course begins.

  1. Scope of Services

7.1. The booked language school or accommodation is responsible for the scope of contractual services as described on our website and in the contract partner’s documents.

7.2. Without the client’s consent, Nipponcademy is entitled to engage third parties (e.g., translators) to assist in performing its duties. The client may only refuse consent if legitimate interests are at risk. If the contractor engages third parties for support, they remain in a contractual relationship exclusively with the contractor. The contractor commits to imposing a confidentiality obligation on any third party employed, corresponding to this contract.

7.3. Missed appointments by the client will not be made up. Fees paid for such appointments will not be refunded.

7.4. If the client cannot attend an agreed appointment, Nipponcademy must be informed no later than 24 hours before the appointment. Otherwise, the appointment will not be refunded.

7.5. Nipponcademy commits to providing the following services depending on the booked Japan stay:

7.5.1. Nipponcademy takes over and coordinates the entire registration process for language schools and accommodations. This includes translating necessary documents into Japanese and forwarding all school fees to the Japanese bank accounts of the contract partners.

7.5.2. Accommodation: Nipponcademy informs the client about accommodation options and handles all application and registration formalities. If the application is rejected, Nipponcademy will look for an alternative, equivalent accommodation.

7.5.3. Visa Application: Nipponcademy advises the client to the best of its knowledge on visa applications. Nipponcademy informs the client about all registration formalities and options for obtaining a visa or applies for all necessary documents for the visa application. It cannot be guaranteed that the client will receive the desired residence permit, as this is beyond Nipponcademy’s control.

7.5.4. Emergency Contact: The client has the option to contact Nipponcademy by phone, email, or messenger for advice or assistance in Japan. This is especially relevant if the client loses their passport, needs to visit a doctor, etc. Nipponcademy advises the client to the best of its knowledge and can assist via video call in communicating in Japanese if help is urgently needed.

7.5.5. Translations: Nipponcademy translates German documents into Japanese for the client, which are needed for course registration and apartment search. This does not include documents that need to be translated by a certified translator.

  1. Protection and Respect of Copyright and Trademarks

The materials issued during a course or made available for download via the internet (scripts, cases, graphical representations, podcasts, videos, etc.) are protected by copyright. The brands and logos featured on the materials are protected under trademark law. Each participant is obligated to use the accessible materials and files only within the expressly permitted scope or as allowed by mandatory legal provisions without our consent and to prevent unauthorized use by third parties. This obligation continues after participation ends. Files and materials may only be accessed (downloaded) and printed by course participants for their own education. Downloading and printing files are only allowed within this scope – participants may use technical assistance from third parties (e.g., a copy shop) for printing. All other rights to the files and materials remain reserved. Therefore, copying files or prints for third parties, distributing or forwarding files to third parties, or otherwise using them for purposes other than personal study, whether for a fee or free of charge, even after course participation ends, requires the express prior written consent of Eurasia-Linkup Nipponcademy GmbH. Usage forms allowed by mandatory legal provisions are, of course, exempt from this consent requirement.

  1. Confidentiality of Access Data

Each participant is obligated to keep their special access data (username and password) for individual use of Nipponcademy’s online offerings confidential and not to share them with third parties. Access data will be deleted and replaced with another code by Nipponcademy upon the participant’s request at any time.

  1. Freedom from Instructions

Nipponcademy is not subject to instructions from the client regarding time allocation and activity planning in fulfilling the contract or performing the agreed activities, unless specified by the nature of the assignment.

  1. Fulfillment of the Contract

Nipponcademy’s services are considered fulfilled and accepted if the client does not raise objections promptly. The time, place, nature, and extent of the defect must be precisely described. If the client justifiably complains about defects in the contractually agreed service, Nipponcademy is obliged and entitled to make corrections.

  1. Provision of Suitable IT Infrastructure and Software

Each participant is responsible for providing and ensuring internet access (hardware, telecommunications connections, etc.) and other technical equipment and software (especially a web browser and Acrobat Reader®) necessary for using Nipponcademy’s online offerings at their own cost and risk.

  1. Liability

We commit to providing the services booked by the participant in full. We are not liable for non-performance of contractual services for reasons beyond our control, including server outages or similar issues not attributable to us. In such cases, the participant is entitled to make up for the lost usage time at the end of the booking period. Our course contents are taught to the best of our knowledge and belief. Participation and completion of all our courses are at the participant’s own responsibility; therefore, we cannot guarantee that the desired goal will be achieved.

The client is personally liable for all damages caused by them. If a third party claims against Nipponcademy due to damages caused by the client during their stay in Germany, Nipponcademy will have a claim against the client. Nipponcademy is not liable for the services provided by contract partners.

  1. Online Dispute Resolution Platform

The European Commission provides a platform for out-of-court online dispute resolution (OS platform), available at https://ec.europa.eu/consumers/odr. We, Eurasia-Linkup Nipponcademy GmbH, are not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.   1. Storage of the Contract Text

The customer can print the contract text before submitting the order to the seller using the print function of their browser. We also send the customer an order confirmation with all order data to the email address provided by them. The order confirmation also includes a link to the terms and conditions, including the withdrawal policy and privacy policy.

  1. Withdrawal Policy

Below you will find information about the conditions and consequences of the statutory right of withdrawal.

Consumers have a fourteen-day right of withdrawal.

  1. Other Provisions

18.1. This contract and its associated annexes constitute the entire agreement between the parties.

18.2. No implicit, oral, or written collateral agreements have been made. Amendments or additions to this contract are only effective if agreed upon in writing. This also applies to changes to this written form clause. Deviating from this, informal changes or additions to this contract are effective if they are individual agreements within the meaning of § 305b BGB. These individual agreements should generally be recorded in writing for evidence purposes.

18.3. Otherwise, the provisions of the BGB apply.

18.4. The parties agree on Celle, Germany as the place of jurisdiction and performance for their mutual rights and obligations under this contract.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Eurasia-Linkup Nipponcademy GmbH, Im Flath 9, 29313 Hambühren, info@nipponcademy.com, Telephone: +49 5084 9609890) of your decision to withdraw from this contract by an unequivocal statement (e.g., your customer account or a letter sent by mail or email).

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse you for all payments received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
